These Terms of Service ("Terms") govern your access and use of the https://onbort.com platform ("Service" or "Platform"). By using the Platform or participating in any battles or quests, you confirm that you have read, understood, and accepted these Terms in full.

IMPORTANT: By depositing ETH into any battle on the Platform, you automatically agree to these Terms of Service and the Privacy Policy. If you do not agree with these terms, DO NOT deposit ETH or participate in battles.

The Platform allows users to complete on-chain quests and receive NFTs. Users may initiate "battles" by depositing Ethereum (ETH), and prize pools are distributed using random numbers generated by Supra VRF.

The Platform is a non-custodial, permissionless, decentralized application (dApp). You retain full control over your funds and wallet at all times.

By using the Service, you confirm that:

• You are at least 18 years old
• You are legally allowed to use blockchain-based applications in your jurisdiction

The Platform does not custody user funds or control wallet interactions. All transactions are executed directly on the blockchain.

We do not guarantee the availability, correctness, or security of the Service.

The Service is provided "as is" and "as available". You understand and agree that:

You bear all risks associated with using the Platform, including but not limited to:

• Smart contract vulnerabilities and bugs
• Loss of funds due to on-chain risks, such as transaction failures, exploits, or network congestion
• Volatility of cryptocurrency values
• Irreversibility of blockchain transactions

You are solely responsible for safeguarding your wallet, private keys, and recovery phrases.

To the maximum extent permitted by applicable law, the Platform operator shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to:

• Loss of funds
• Transaction failures
• Exploits or smart contract errors
• Network congestion or delays

You waive any right to seek damages or legal remedies against the project operator.

We make no warranties or representations, express or implied, regarding the Service, including but not limited to:

• Fitness for a particular purpose
• Availability or uptime
• Accuracy or reliability

You agree to indemnify, defend, and hold harmless the Platform operator, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees and costs) arising out of or in connection with:

• Your use of the Service
• Your breach of these Terms
• Your violation of any law or rights of a third party

The Service may use third-party services, such as Reown for wallet connection and Supra VRF for randomness. By using the Service, you acknowledge and agree that:

• The Platform operator is not responsible for the actions, products, or services of any third parties
• Your use of third-party services is at your own risk

This project is operated by an anonymous individual and is not a legal entity. The Platform does not fall under any specific jurisdiction and is provided globally in a decentralized manner.

All interactions occur on-chain and are governed by code, not contracts.

We reserve the right to modify these Terms at any time. Changes will be published on the Platform. Continued use of the Service after changes constitutes acceptance.

We may terminate or suspend your access to the Service at any time, with or without cause, and without liability to you.

You must comply with all applicable laws and regulations when using the Service. You are responsible for ensuring that your use of the Service does not violate any laws in your jurisdiction.

The Platform operator shall not be liable for any failure or delay in performing its obligations under these Terms if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authority, fire, floods, accidents, strikes, or failures in telecommunications, network, or internet services.

By participating in battles, connecting your wallet, or interacting with the Platform, you explicitly confirm your acceptance of these Terms.

Users must check the box acknowledging these Terms before depositing ETH in battles.

Automatic Agreement: The act of depositing ETH into any battle constitutes your explicit agreement to these Terms of Service and the Privacy Policy. This agreement is binding and irrevocable for that specific battle transaction.
